1. Who we are & what this is

Orange Potato is a service that drafts and schedules social posts for you. These terms are the agreement between you and us. If you use the app, they apply.

These Terms of Service ("Terms") govern your access to and use of the Orange Potato platform ("Service"), operated by Orange Potato, Inc. ("Orange Potato," "we," "us"). By creating an account or accessing the Service, you agree to these Terms.

2. Your account

You need to be 18+. Keep your password to yourself. You're responsible for what happens on your account, including what gets posted.

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities conducted through your account. You agree to notify us immediately of any unauthorized use.

3. Connected social accounts

When you connect Facebook, Instagram, TikTok, YouTube, or X, you give us permission to post on your behalf. You can disconnect any time. Their rules still apply — we don't override them.

By connecting third-party social media accounts to the Service, you grant Orange Potato permission to publish content to those accounts according to your configured schedule and approval settings. Your use of those platforms remains subject to their respective terms of service.

4. Content you put in

Your brand voice, your uploads, your words — you own them. We only use them to run the service for you, not to train general AI models.

You retain all ownership rights to content you submit ("User Content"). You grant Orange Potato a limited, non-exclusive license to process, store, and transmit User Content solely to operate the Service on your behalf. We will not use User Content to train foundation models outside your brand.

5. Content we generate for you

Anything the AI drafts for you is yours to use, edit, or delete. You're responsible for reviewing it before it goes public.

Subject to your payment of applicable fees, Orange Potato assigns to you all right, title, and interest in AI-generated content produced for your account. You acknowledge that AI-generated content may require human review before publication, and you are solely responsible for the content ultimately published.

6. What you can't do

No hate speech, spam, scams, adult content involving minors, impersonation, or trying to break the platform. If you do, we remove your access.

You agree not to use the Service to generate or publish content that is unlawful, defamatory, harassing, fraudulent, infringing, or otherwise harmful. We reserve the right to suspend or terminate accounts that violate these prohibitions.

7. Payment & credits

Plans bill monthly or annually. Credits reset each cycle. Top-ups don't expire for 12 months. You can cancel anytime.

Subscription fees are billed in advance on a recurring basis. Credits allocated under a subscription tier expire at the end of each billing cycle. Credit top-ups remain valid for 12 months from purchase. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

8. No guarantees

We try hard but sometimes things break. The AI might write something weird. A post might fail to publish. We're not liable if that costs you business.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. Orange Potato's aggregate liability shall not exceed the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Changes to these terms

If we change something important, we'll email you at least 30 days ahead. If you keep using the app after, you've accepted the change.

We may revise these Terms from time to time. Material changes will be communicated via email to the address on file at least thirty (30) days prior to taking effect. Continued use of the Service following such notice constitutes acceptance of the revised Terms.

10. Ending the agreement

You can delete your account anytime. We can suspend accounts that abuse the service. Either way, this document stops applying once the account is closed.

Either party may terminate this agreement at any time. Upon termination, your right to access the Service ceases and we will delete or anonymize your data within 90 days, except where retention is required by law.
